User Agreement (App)

1. Acceptance of the Terms

Once you click the login button on the login page, you are deemed to have read and agreed to enter into an agreement with BEYOND Expo and to be bound by all of the terms and conditions in this User Agreement and all terms and conditions under the Privacy Policy and other provisions posted on the BEYOND Expo APP, and thus become a registered user of BEYOND Expo.

2. Conditions to become a registered user of BEYOND Expo

1. To become a registered user of BEYOND Expo APP, you must meet all of the following conditions: you must be using the BEYOND Expo APP service for the purpose of technology and innovation exchange at the date of login and thereafter, and you must be 18 years of age or older at the date of login.
2. In order to better enjoy BEYOND Expo’s online platform services, users should comply with the requirements of the BEYOND Expo APP login registration mechanism and provide BEYOND Expo with their true, correct, latest and complete information.
3. If a user intentionally provides false identity or company information for login registration and releases false information, it is considered a serious violation of this User Agreement and BEYOND Expo has the right to suspend or terminate the user account and stop providing services. BEYOND Expo will pursue the legal responsibility of the user if the false registration or release of false information causes economic or reputational damage to BEYOND Expo APP.

3. User account, email verification code and security

1. After completing the login process, you are responsible for the security of your account within the BEYOND Expo APP. You are solely responsible for all activities that occur under your account, including any information, materials, text, software, audio, images, video, messages or other materials uploaded, posted or otherwise transmitted via BEYOND Expo, whether publicly or privately, by the content provider.
2. BEYOND Expo will not be responsible for any adverse consequences arising from the disclosure of your account due to improper use or other reasons not caused by BEYOND Expo, which may result in the disclosure of your data or information.
3. You are not allowed to inform third parties of your account or provide it to them for their use, for example to purchase BEYOND Expo services on their behalf. If this results in the disclosure of user privacy or the loss of the BEYOND Expo platform, you shall be liable for the corresponding responsibility.

4. Service Description

1. BEYOND Expo provides network services to you via the Internet. In order to use the Internet service, users should equip themselves with the necessary equipment to access the Internet, including mobile data for mobile phones, etc., and pay all fees required to access the Internet.
2. For those who use BEYOND Expo for illegal activities, or whose words or actions (whether online or offline) deviate from the purpose of BEYOND Expo’s technology and innovation exchange, BEYOND Expo will deal with them seriously, including blacklisting them, making the circumstances of their complaints public, deleting their user accounts and other punitive measures. BEYOND Expo will pursue legal responsibility for users who cause economic or reputational damage to BEYOND Expo.
3. BEYOND Expo reserves the right to send advertisements, emails, and recommend content to its users.

5. Disclaimers

1. BEYOND Expo does not guarantee that the services it provides will meet the requirements and expectations of all users, nor does it guarantee that the services will not be interrupted. Users may encounter errors and network delays while using BEYOND Expo services and BEYOND Expo will not be held liable.
2. For content transmitted by users through the services provided by BEYOND Expo, BEYOND Expo will endeavor to strictly review the content in accordance with the relevant national regulations. If users encounter suspected illegal and disorderly conduct when using BEYOND Expo services, please report the suspected problematic content through the reporting channel provided within the BEYOND Expo APP. BEYOND Expo has the right to stop transmitting any of the aforementioned content and take corresponding actions in accordance with the law, including but not limited to suspending the publisher from using the APP and related services in whole or in part, keeping relevant records, and reporting to and cooperating with relevant authorities in accordance with national laws and regulations and relevant policies when necessary.
3. BEYOND Expo does not guarantee the correctness, legality or reliability of the content of the advertisements, links and information provided by BEYOND Expo, and the advertisers are responsible for the related responsibilities; furthermore, the contact or commercial dealings between users and advertisers via BEYOND Expo services are entirely between users and advertisers, are not related to BEYOND Expo. BEYOND Expo shall not be liable for any damage or loss arising from the commercial dealings.
4. BEYOND Expo has adopted relevant confidentiality measures to ensure that information, qualifications, certificates and pictures of documents uploaded by users are not disclosed. However, the user shall also guarantee the correctness, legality or reliability of the information, qualifications, certificates and document pictures uploaded by him/her. Any legal disputes caused by the appearance of false, imitation, or inaccurate information, qualifications, certificates and document pictures shall be the full responsibility of the provider of such information.
5. Whether to use the APP Service to download or obtain any information is your own consideration and risk, and BEYOND Expo is not responsible for any damage to your cell phone system or loss of data as a result of the download of any information.
6. BEYOND Expo does not guarantee or promise the results of any activities planned, initiated, organized or hosted by the APP. BEYOND Expo does not assume any responsibility for any personal or reputational damages or other damages to the user or others arising from such activities.
7. In case of reports from users, BEYOND Expo will carefully verify the content of the reports that violate the privacy, reputation and other legal rights of users, all legal responsibilities will be borne by the reporter and are not related to BEYOND Expo.
8. Although BEYOND Expo has taken appropriate technical safeguards, users may still receive various types of advertisements (except for advertising letters sent by BEYOND Expo) or other information, for which BEYOND Expo is not responsible.

6. Users have the following rights with respect to their personal data:

1. To make inquiries and requests for access at any time, except in rare special cases (such as being blacklisted by the software, etc.) where such inquiries and access cannot be provided.
2. Adding or correcting at any time, except in rare and exceptional cases (such as when the software or relevant authorities preserve evidence for judicial proceedings, etc.) where it is not possible to add or correct.

7. You shall comply with the following laws and regulations:

1. When you use the BEYOND Expo Services, you shall comply with the provisions of the Contract Law of the People’s Republic of China, Copyright Law of the People’s Republic of China, Decision of the Standing Committee of the National People’s Congress on Maintaining internet security, Law of the People’s Republic of China on Guarding State Secrets, Telecommunications Regulations of the People’s Republic of China, Regulations of the People’s Republic of China on the Safety Protection of Computer Information Systems, Interim Provisions on the Administration of International Networking of Computer Information Networks of the People’s Republic of China and Its Implementation Measures, Regulations on Confidentiality Management of International Networking of Computer Information Systems, Administrative Measures for Internet Information Services, Management Measures for Security Protection of International Networking of Computer Information Networks, Regulations on the Administration of Internet Electronic Announcement Services, Cybersecurity Law of the People’s Republic of China and other relevant Chinese laws and regulations.
2. In any event, BEYOND Expo may terminate the provision of the Services to a user at any time without any prior notice if BEYOND Expo has reason to believe that any conduct in the course of the user’s use of the BEYOND Expo APP Services, including but not limited to any statements and other conduct by the user, violates or may violate any provision of the above laws and regulations.

8. Users are prohibited from engaging in the following actions:

1. Posting information or using BEYOND Expo’s services to create, copy, publish or disseminate the following information on BEYOND Expo APP or using BEYOND Expo’s services: those that oppose the basic principles established by the Constitution; Those that endanger national security, disclose state secrets, subvert state power, or undermine national unity; Those that damage national honor and interests; those that incite ethnic hatred, ethnic discrimination, and undermine national unity; Undermining the state’s religious policy and promoting evil cults and feudal superstitions; Those that spread rumors, disrupt social order and undermine social stability; Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crime; Insulting or slandering others and infringing on their legal rights; Contains content that is false, harmful, coercive, infringes on the privacy of others, harassment, infringement, vilification, vulgarity, obscenity, or otherwise unethical or objectionable; Contains other content that is restricted or prohibited by Chinese laws, rules, regulations, ordinances, and any norms with legal effect.
2. Use the BEYOND Expo Services in any way that is harmful to the interests of minors.
3. Impersonate any person or organization, including, but not limited to, impersonating a BEYOND Expo staff member or making false statements or misrepresentations in connection with any person or organization.
4. Uploading, posting or otherwise transmitting content that violates the portrait, reputation, privacy, proprietary rights, trademarks, copyrights, trade secrets or other proprietary rights of any person.
5. Upload, distribute or otherwise transmit viruses or other software code, files or programs.
6. Stalking or otherwise harassing other users.
7. Intercept, tamper with, collect, store or delete personal information or data of others without legal authorization, or use such information known to you for any illegal or improper purpose.
8. Interfere with the BEYOND Expo service in any way.

9. Special Regulations

1. If you violate Article 8 of this User Agreement by posting inappropriate content, BEYOND Expo reserves the right to terminate the provision of the Services to such user at any time without any prior notice.
2. BEYOND Expo reserves the right to freeze the user’s account or otherwise suspend the service to the user and hold the user liable for damages if the user does any of the following or if the following circumstances exist:

1. Posting involving advertising, marketing, direct sales and other content.
2. Posting of pornographic and obscene content.
3. Posting illegal/politically sensitive content.
4. posting false information, including but not limited to untrue personal information, company information, etc.
5. Use the services provided by BEYOND Expo to solicit the privacy of others.
6. Posting content that involves personal attacks or other violations of others’ rights and interests.
7. Use training fees, clothing fees, etc. to obtain personal belongings.
8. Harass other users.
9. Other violations of laws and regulations.

10. About user uploads or posts at BEYOND Expo

1. Any content (including but not limited to photos, text, etc.) uploaded or posted by the users on BEYOND Expo is deemed to be a free, non-exclusive right of use granted by the users to BEYOND Expo, and BEYOND Expo has the right to copy, reproduce, etc. the above content for the purpose of displaying, distributing and promoting the content. This right of use shall continue until the user notifies BEYOND Expo in writing that further use is prohibited and BEYOND Expo actually receives such written notice. For use by BEYOND Expo partners or at live events, BEYOND Expo will obtain prior consent from the users, but use within BEYOND Expo is not subject to this limitation.
2. The user shall be solely responsible for any infringement or claim by any third party as a result of such uploading or posting by the user.
3. If any third party copies, edits, or reproduces the content you post in the public use area of BEYOND Expo, the legal consequences and responsibilities arising from such behavior shall be borne by the perpetrator and not BEYOND Expo.

11. Information storage and restrictions

BEYOND Expo reserves the right to establish general measures and limitations, including, but not limited to, the maximum period that chat logs, posted content or other uploaded content will be retained by the APP Service, the maximum number of messages that can be sent or received per account, and the size of individual messages that can be sent or received. BEYOND Expo is not responsible for the deletion or non-storage of any messages, communications and other content stored or transmitted through the Services. User agrees that BEYOND Expo reserves the right to close accounts that have not been used for an extended period of time. BEYOND Expo also reserves the right, at its sole discretion and with or without notice to the User, to change these general measures and restrictions at any time.

12. End of Service

If you object to the content of any User Agreement or disagree with subsequent modifications to the User Agreement, or are dissatisfied with the BEYOND Expo Services, you have the following rights: to no longer use the services provided by BEYOND Expo APP; to terminate your eligibility to use the BEYOND Expo Services; and upon termination of the services, your right to use the BEYOND Expo APP Services immediately terminates and BEYOND Expo shall have no further obligations to you.

13. Prohibition of commercial activities

1. Agree not to reproduce, copy, sell, resell or use for any other commercial purpose the services or any part of the services provided by the BEYOND Expo APP.
2. Illegal commercial practices through BEYOND Expo APP are prohibited and we will end your eligibility to use the BEYOND Expo APP service if found.

14. Liability for Violation of Contract

1. If you use false identity information or company information to register, publish false information, or publish serious illegal content such as pyramid schemes, pornography, or reactionary content, you are considered to be in serious breach of this Agreement and shall bear the economic loss and reputation damage caused to BEYOND Expo.
2. If you make any claim or demand against BEYOND Expo by any third party as a result of providing, posting or republishing content through the services provided by the BEYOND Expo APP, violating these Terms of Service, or infringing any rights of others, you shall indemnify BEYOND Expo or other partners for damages, including but not limited to the amount of damages, attorneys’ fees and reasonable investigation costs.
3. When you complain about another user’s illegal behavior or violation of this User Agreement, the complainant shall bear all legal responsibilities arising from the false complaint. If you violate the legal rights and interests of others, the complainant shall independently assume full legal responsibility. If any damage is caused to BEYOND Expo, the complainant shall bear the corresponding compensation responsibility for BEYOND Expo.

15. Changes and modifications

BEYOND Expo reserves the right to change and modify the terms of this User Agreement at any time according to the law. In the event of changes to the User Terms, BEYOND Expo will provide an update alert within the APP or send the latest version of the User Agreement to the User by email. If the User does not agree with the changes to the User Terms, the User may voluntarily stop using BEYOND Expo APP and services.

16. Force majeure

1. “Force Majeure” means an event that is beyond BEYOND Expo’s reasonable control, unforeseeable or, if foreseen, unavoidable, which prevents, affects or delays BEYOND Expo’s performance of all or part of its obligations under these User Agreement Terms. Such events include, but are not limited to, acts of government, natural disasters, war, hacker attacks, computer viruses, network failures, etc. Force majeure may result in the inability to access BEYOND Expo, slow access, loss of stored data, leakage of users’ personal information, and other adverse consequences.
2. In the event of a force majeure event, BEYOND Expo may suspend performance of its obligations under this User Agreement until the effects of the force majeure are removed and shall not be liable for breach of contract; however, it shall use its best efforts to overcome the event and mitigate its negative effects.

17. Notification

Notices from BEYOND Expo to its users will be in the form of tweets from the site, emails or page announcements. BEYOND Expo may provide notice in the form described above in the event of modifications or other changes to the User Agreement Terms.

18. Application of law and jurisdiction

The validity, performance, interpretation and dispute resolution of this User Agreement shall be governed by the laws in force in the People’s Republic of China, and any dispute arising shall be submitted to the Shanghai Arbitration Commission, whose arbitration award shall be final. This User Agreement shall not affect the validity of other terms and conditions if some of the terms and conditions are invalid due to contradiction with the current laws of the People’s Republic of China.
